2. Purpose and acceptance
These Terms and Conditions (hereinafter, "Conditions") regulate the purchase of products offered on defrox.es (hereinafter, "the Website") by any natural or legal person (hereinafter, "the Client").
Placing an order implies the express, full, and unreserved acceptance of these Conditions in their current version at the time of the order. These Conditions complement, without replacing, the rights recognized to the Client by applicable consumer legislation.
3. Products
The products offered on defrox.es are those described in the corresponding product sheets. The images are illustrative and may present minor variations from the actual product (color, tone, etc.) without constituting a defect.
DefroX reserves the right to remove products from the catalog or modify their characteristics without prior notice, without affecting already confirmed orders.
4. Prices
Prices are shown in euros (€) and include the corresponding VAT. Shipping is free.
Prices may be modified at any time, but the modification will not affect orders for which a confirmation of receipt has already been sent to the Client.
5. Purchase process
- The Client selects the products and adds them to the cart.
- Reviews the contents of the cart and proceeds to checkout.
- Enters their shipping and billing details.
- Selects the payment method.
- Expressly accepts these Conditions by checking the corresponding box.
- Confirms and pays for the order.
- Receives an order confirmation email.
The order confirmation and effective collection of the amount complete the sales contract.
6. Payment methods
The following methods are accepted: credit or debit card (Visa, Mastercard, American Express), Shop Pay, Apple Pay, Google Pay, PayPal, and any other method enabled at checkout. All payments are processed through certified secure gateways; DefroX does not store card data.
7. Shipping and delivery
- Territorial scope: Shipments are made to the areas indicated at checkout.
- Delivery times: Indicative. They start counting from the order confirmation.
- Shipping costs: Shipping is free on all orders.
- Risk: Ownership and risk of the product pass to the Client at the time of delivery.
If the product is not delivered within a reasonable time due to reasons attributable to DefroX, the Client may request delivery within an additional period and, if delivery does not occur, terminate the contract with a full refund of the amount.
8. Right of withdrawal
In accordance with articles 102 et seq. of Royal Legislative Decree 1/2007 (LGDCU), the consumer Client has 14 calendar days from receipt of the product to withdraw from the contract without needing to provide justification and without penalty.
8.1 How to exercise it
The Client must communicate their decision to withdraw by:
- message via the contact form indicating name, order number, product to be returned, and express intention to withdraw; or
- The official withdrawal form template included at the end of this document.
8.2 Product return
The product must be sent without undue delay and, in any case, within a maximum period of 14 calendar days from the communication of the decision to withdraw. Direct return costs are borne by the Client, unless expressly stated otherwise.
The product must be returned in perfect condition, with its original packaging and without signs of use beyond what is necessary to verify its nature and function. The loss of value of the product due to handling other than that necessary may result in a reduction of the refund.
8.3 Refund
DefroX will refund the Client all amounts paid (including standard initial shipping costs) within a maximum period of 14 calendar days from the communication of withdrawal. The refund will be made by the same payment method used in the purchase, unless otherwise agreed.
DefroX may withhold the refund until the product has been received or until the Client provides proof of its return.
8.4 Exceptions to the right of withdrawal
Withdrawal will not proceed in the cases of article 103 LGDCU, among others:
- Products made to the Client's specifications or clearly personalized.
- Sealed products that, once opened, cannot be returned for reasons of health protection or hygiene.
9. Legal guarantee of conformity
In accordance with articles 114 et seq. of Royal Legislative Decree 1/2007 (modified by Royal Decree-Law 7/2021), products are covered by the legal guarantee of conformity recognized by current Spanish consumer law.
If the product presents a lack of conformity (manufacturing defects, malfunction, characteristics different from those advertised), the Client must contact us via the contact form indicating the order number, photographs of the product, and a description of the problem. DefroX will evaluate each case and, as appropriate, will manage the repair, replacement, price reduction, or termination of the contract in accordance with applicable legal deadlines.
The warranty does not cover damages resulting from misuse, negligence, accident, alteration of the product, or use contrary to instructions.
10. Claims and dispute resolution
The Client may submit any claim via the contact form. We commit to responding within a reasonable timeframe.
In accordance with Regulation (EU) No 524/2013, in case of a dispute, the Client may resort to the European Commission's Online Dispute Resolution Platform.
11. Reviews
Reviews published on defrox.es are collected and managed through Judge.me. DefroX implements reasonable measures to ensure that reviews marked as "verified" come from Clients who actually made the purchase. We do not financially incentivize the publication of favorable reviews or remove authentic negative reviews.
12. Liability
DefroX will fulfill its contractual obligations with due diligence. Liability for non-compliance will be limited to the amount paid by the Client for the product in question, except in cases of fraud or gross negligence or when applicable law establishes a different limitation.
DefroX will not be liable for delays or non-compliance arising from force majeure.
13. Data protection
The processing of the Client's personal data is governed by the Privacy Policy.
14. Modification of conditions
DefroX reserves the right to modify these Conditions at any time. Changes will apply to orders placed after their publication. Orders placed before the change are governed by the Conditions in force at the time of purchase.
15. Applicable law and jurisdiction
These Conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the Client's domicile when the Client is a consumer. In other cases, to the Courts and Tribunals of Madrid, with express waiver of any other jurisdiction.
